Justice Ozegya Rules in Favour of Attorney General as Plaintiff Fails to Appear in Court

The High Court of Nasarawa State sitting in Keffi today struck out a suit filed by former Chairman of the Nasarawa State Teachers Service Commission, Abubakar Gada, over lack of diligent prosecution.

The presiding judge, Justice Ozegya, struck out the case after the plaintiff and his counsel failed to appear at the resumed hearing.

Counsel to the Nasarawa State Government, led by the Attorney General and Commissioner for Justice, Isaac Danladi, alongside E.U. Aliyu, A.H. Akuson, and R.A. Umaru, had urged the court to strike out the matter, citing want of diligent prosecution.

Danladi argued that the absence of the plaintiff and his legal representative demonstrated a lack of seriousness in pursuing the suit, thereby justifying the application.

After carefully reviewing the submissions presented by the Attorney General and his legal team, Justice Ozegya found merit in the application and consequently struck out the suit.

The ruling effectively ends the case at this stage, pending any fresh legal steps the plaintiff may choose to initiate in accordance with the law.
