Niger Community Wins ₦2.076bn Judgment Against HYPADEC

Justice Mohammed Adishetu Mohammed of the Minna High Court number four,has ordered the Hydro Electric Power Producing Area Development Commission,(HYPADEC),to pay the sum of two billion, and seventy six million naira (N2,076,000,000,00) to Danu Jumu Community in Rafi Local Government Area of Niger State.

Delivery Judgement in suit Nos. NSHC/MN/ 77/2023, filed by Umar Isah and Mohammed Attahiru through their Attorney Kabir Bala Ibrahim Esq of the Summit Chamber,approached the Court that the plaintiffs claimed that the defendants refusal to pay compensation to the plaintiffs communities and settle them at a safer location as done to other communities in the same is unlawful.

Joined in the suit include the Attorney General of the Federation and the Minister of Power as defendants.

Justice Mohammed Mohammed further ordered the defendants to resettle the plaintiffs’Communities to a safer location away from the site in which the Dam project was located,to pay the sum of N5,000,000,00 as general damages and   the sum of N5,000,000,00 as cost of litigation.

“ Having held that the plaintiffs have established their claims against the defendants the sole issue raised for determination is hereby resolved in favour of the plaintiffs and against the defendants”

He further ordered that the defendants’ communities should be resettled at a safer location away from the site of the Dam project and the sum of one million naira as cost of litigation.
