The Nasarawa State Government and the State House of Assembly have filed a motion on notice before the High Court of Nasarawa State, Lafia, seeking a stay of execution of the ruling delivered on December 11, 2025, in the suit filed by Hon. Mohammed Haliru Arabo. The suspended Chairman of Lafia Local Government Council.
The motion, brought pursuant to Section 36 of the 1999 Constitution and Order 41 of the High Court of Nasarawa State (Civil Procedure) Rules 2010, was filed by the defendants/applicants, including the Nasarawa State House of Assembly, the Speaker of the House, the Nasarawa State Government, and the Attorney General of the state.
In the application, the defendants are praying the court for an order staying the execution of the ruling of Justice Aisha Mohammed Usman in Suit No. NSD/LF/150/2025, reinstating Arabo pending the hearing and determination of the Motion filed by the House of Assembly to set aside the ruling of the Court.
The House of Assembly equally filed a motion to set aside the ruling of the High Court on the grounds that the act sought to be restrained is already completed and the grounds that the Court lacks powers to determine a substantive suit by an interlocutory application.
The House, also filed another Motion seeking a restraining order against the Inspector General of Police, the Commissioner of Police and the Chief Registrar of the High Court of Nasarawa State from taking step to enforce the ruling pending the hearing and determination of the Defendants' application before the Court.
The motions are expected to be heard on the date to be fixed by the Court.
