Federal High Court Sitting in Lafia Strikes Out FOI Suit, Upholds Nasarawa AG's Objection
Court Rules Ayuba Umar's Action Incompetent, Declines Jurisdiction
By Suleiman Abubakar Rimi Uku Lafia
The Federal High Court sitting in Lafia, Nasarawa State, has struck out a Freedom of Information (FOI) Act suit filed by Mr. Ayuba Umar, declaring the action incompetent and outside the jurisdiction of the court.
In a ruling delivered on June 3, 2026, the court upheld the preliminary objection raised by the Honourable Attorney General and Commissioner for Justice of Nasarawa State, Isaac Danladi, who challenged the competence of the suit.
Barr. Danladi had argued that the action was fundamentally defective and, as such, deprived the court of the jurisdiction required to entertain and determine the matter.
Agreeing with the submissions of the Attorney General, the court held that the suit was incompetent and consequently struck it out for lack of jurisdiction.
The ruling effectively brings to an end the Freedom of Information Act case instituted by Mr. Ayuba Umar before the Federal High Court in Lafia.
