The Minna High Court Number Six sitting at the Judiciary Complex headquarters has convicted and sentenced a 47 years old man to a total of seventeen years imprisonment without an option of fine.
Justice Balkisu Gambo Yusuf who handed down the verdict held that the convict is to
run consecutively.
Zingfa Nanboi was arraigned by the office of the Attorney General of Niger State,on three count charges bordering on Criminal conspiracy,attempted culpable homicide and armed robbery.
According to the Prosecuting Counsel Fatima Mohammed Esq, a Director in the Ministry of Justice,the three count charges contravened sections 1 (1) a and b of the Robbery and special provision Act,section 99 and 229 of the penal code law of Niger State.
The convict was said to have on the 22nd of May,2022 conspired along with one Frank Moses who was not charged to court boarded a Keke napep of one Adamu Saidu,from Obasanjo Complex in Minna to Maikunkele,while on their way,along the Minna airport the convict strangulated their victim with a cable behind and tight his mouth for him not shout.
“ In the enshewing attack on their victim they pushed him out of the moving cyclist unconscious until he woke up only to see himself in the bush. He was picked the following morning by a good Samaritan and took him to house” she told the court.
A total of five witnesses testified and three pieces of evidence were all tendered during the trial which included his statement, audio visual of his statement and his oral testimonies in the court.
While reviewing all the evidence and the testimonies of the witnesses, Justice Balkisu Gambo held that the Prosecuting counsel was able to diligently prove the three count charges of Conspiracy,attempted culpable homicide and armed robbery beyond every reasonable doubt.
Also,the Judge held that “ from all the evidences and the witnesses adorsed by the prosecuting counsel, the three count charges of Conspiracy,attempted culpable homicide and armed robbery has been established against the defendant and is hereby convicted accordingly”
At this point the defence counsel to the convict, Chief Olukunle Oyewole Esq, while pleading on behalf of the convict, pleaded that “ My Lord temper Justice Mercy while passing your judgement on him. He is a young promising man married with children. Kindly
temper justice my Lord”
She said,” having listened to the plea of the defence counsel and been the first offender, he is hereby convicted to ten years imprisonment in the armed robbery and seven years imprisonment for the offence of attempted culpable homicide without an option of fine.
All the sentences to run consecutively to commence from the year he spend in custody.
