Police in Zaria Local Governments area of kaduna State had arrested and arraigned a retired Upper Shari'a Court Judge, Mahmoud Shehu refered to as dependant before a Magistrate Court sitting at Tudun Wada Zaria for inner trace fassing, used of force and assaulting a housewife who is a blind person contrary to section 327,237 and 239 of penal code law of Kaduna State 2017.
The prosecution, Inspector Adamu Abubakar the told the Court that on the 6th of this month one Garba Adda' u a resident of Gonar Ganye Tudun Jukun Zaria lodged a complain at Tudun Wada Divisional Police headquarters that the dependant allegedly lucked up their main gate and follow his wife who is a blind person into her room and beats her along side 2 ladies who attempted to give the victim cover.
He added that the dependant's action resulted in rushing her (the victim) to health facility at Tudun Wada for medical attention.
When the Court ask the defendant if he committed the offence he pleaded not guilty.
The defence Counsel Barrister SM Abubakar applied for a self bail becouse of the personality his client as a retired Upper Shari'a Court Judge.
The Prosecution objected the application based on the nature of the case as both parties were staying at the same compound that the complainant's safety was at stake.
However, the presiding Magistrate Lukman Sidi granted the bail on the dependant in the like sum of N50.000 and one surety who must resident of the Court jurisdiction with Passport and full address.
The Court held that the event that the condition was met the must be remanded correctional facility.
The Court therefore adjourned the case to October, 8 for hearing
It also held that the parties must leave in peace adding that any one breach peace must him or her self to blame.
