The Minna High Court number two,has adjourned suit filed against the Care taker committee of Niger state Parent Teacher Association (NIPTA) to 9th,April 2026 for commencement of hearing.
The adjournment was to enable the other parties in the matter to be served with the originating service for them to appear in court.
Joined in the suit Number NSHC/MN/446/2025, include Niger State Ministry of Basic Education, Hajiya Maimuna Mohammed Director General School and Education Reforms Niger State,Professor Yakubu Auna,Caretaker Committee Niger State Parent Teachers Association and Incorporated Trustee of National Parent Teachers Association of Nigeria (NAPTAN).
The Plaintiff in the matter, Mallam Yunusa Adamu, has approached the court through his Counsel Sadeeq Ma’aji to challenge the arbitrary dissolution of the executive committee of NIPTA praying the court to invalidate the dissolution by the third respondent
The counsel in his originating Writs held that the unlawful dissolution of the state executive of the NIPTA was not in compliance with the provision of the companies and Allied Matter Act (CAMA) praying the court to invalidate the dissolution
However at the resumed plenary today Monday which was earlier scheduled for commencement of hearing, NAPTA couldn't appear in court citing that they were not served with the originating process of the case.
Counsel to the plaintiff Sadiq Maaji told the court that all attempts to effect the personal service to them as required by law was not successful as their head offices addresses were in Lagos and Abuja.
He maintained that an ex parte application will be raised for the court to grant them to serve all the respondents with the originating process and other court processes in their head offices.
The suit also sought the court to interpret section 850, sub section one of the CAMA 2020, to the effect that the procedures laid down in the Act were not followed.
After hearing the submissions of both counsels,Justice Mikhail Abdullahi adjourned the case to 9th of April 2026 for the commencement of hearing, and directed that the respondents should be served with the hearing notice.
