The Niger State Parent Teachers Association (NIPTA), has called on the Corporate Affairs Commission (CAC) to investigate the registration status of the National Parents Teachers Association of Nigeria (NAPTAN) with a view to knowing the authenticity and genuineness of the association.
The call was contained in a petition forwarded to the Commission by a Minna based legal practitioner Barrister Ibrahim Ndamitso a copy made available to Newsmen in Minna at the Weekend.
The Petition, Titled: “Request For The Dissolution Of Incorporated Trustee Of National Parents Teacher Association (NAPTA) With Registration Number 8588 Registered On 22,June 1995 For Breach Of It's Constitution And Lack Of Fair Representation In The Board Of Trustees”
The legal practitioner alleged in the petition that the Association is parading a registration number 8588 purportedly issued to it by the Corporate Affairs Commission which called for urgent investigation to determine the genuineness of the said registration status From the CAC.
According to the petition, the Niger State Parents Teacher Association NIPTA has carried out investigation on the registration status of NAPTAN which revealed that the registration was obtained through misrepresentation and concealment of facts
The petition alleged that after a thorough investigation carried out by NIPTA,it was revealed that the NAPTAN board of trustees (BOT),were not constituted in line with the provisions of the constitution of NAPTAN which called for urgent and discreet investigation to be carried out to determine the legality and otherwise of the association.
It further alleged that the board of trustees were not elected nor nominated through a transparent process nor do they represent the thirty six states or six geo- political regions of the country adding that with only a few groups of individuals from Lagos,Adamawa and Katsina states parading themselves as board of trustees of NAPTA
Similarly,the legal practitioner claimed that the association has no any traceable states and Nigeria People's records of resolution to have the board of trustees constituted
“We are solicitors to the Incorporated Trustee of the Niger State Parent Teachers
Association (NIPTA) with registration number 8307546 whom shall hereinafter be
referred to as 'our client' and on whose instruction we write you this letter.
“Our client wish to bring to your attention a matter of grave concern regarding the
registration status and mandate of the National Parent Teachers Association of Nigeria (NAPTAN) registered on June 22, 1995 with Registration No. 8588.
“After conducting a thorough investigation, our client discovered that the NAPTAN
Board of Trustees (BOT) was not constituted in accordance with the provisions of
the Constitution of the NAPTAN.
“None of the members of the Board of Trustees are from Eastern and Southern regions of the
country, no representation from the North central region of the country.
“This is a clear case of lack of fairness in the composition of the NAPTAN Board of Trustee
and contrary to the NAPTAN constitution.
“The NAPTAN Board of Trustees may have claimed to have been elected or nominated through a national referendum, but facts at our client's disposal indicate that no such referendum was conducted across the country.
“The lack of proper nomination or election of NAPTAN BOT members raises serious questions about the legitimacy and credibility of the said B0T.
“It is also our client's concern that there are no traceable records of BOT meetings
of NAPTAN, this amounts to a blatant infringement of the provision of the
NAPTAN constitution as to conduct of meetings.
“We wish to also relate the conspiracy of the NAPTAN with the Niger State Ministry of Basic and Secondary Education to truncate the smooth activities of the Niger State Parent Teachers Association (NIPTA) which is dully registered under Part C of the CAMA, 2020 with Registration Number 8307546 by arbitrarily dissolving the NIPTA in clear violation of and disregard to Section 850(1) of the CAMA, 2020 the petition asserted
Barrister Ibrahim Ndamitso urged the Corporate Affairs Commission to as a matter of urgency call for the investigation and registration status of the Incorporated Trustee of the National Parent Teacher Association of Nigeria (NAPTAN), with registration number 8588,and verify the authenticity of the documents submitted during the registration process.
Determine whether the membership of the Board Of trustees of the National Parent Teachers Association Of Nigeria (NAPTAN) was constituted in accordance with the provisions of the constitution of CAC’s regulations.
To ascertain by means of National identification number/ Driving license and any other legitimate means if the Bot members are still alive and to produce minutes of the board of trustees’s annual general meetings of NAPTAN since its registration year in 1995.
The Legal Practitioner also requested the CAC to activate its powers under Section 850(1) cf the Companies and Allied Matters Act, 2020 by filing a petition in a competent court for the dissolution of the Board of Trustees of the National Parent Teachers Association of Nigeria (NAPTAN) and
constitute an interim leadership to pilot the affairs of NAPTAN and deregister NAPTAN and take appropriate action to prevent the association from operating without a valid handover.
