Justice Inyang Ekwo of the Federal High Court, Abuja, on Monday dismissed a suit seeking the removal of Dr. Abdullahi Ganduje as the National Chairman of the All Progressives Congress (APC).
The court ruled that the claimant lacked the necessary legal standing (locus standi) to bring the case forward.
In his judgment, Justice Ekwo upheld the preliminary objections raised by the 2nd and 3rd defendants.
The 2nd defendant argued that the suit should be struck out due to the claimant’s lack of locus standi.
The 3rd defendant added that the claimant, representing the ‘Northern Central APC Forum,’ was not a legally registered entity and thus could not sue.
Justice Ekwo ruled that the APC group lacked juristic personality and had no legal capacity to file the suit.
He also noted that the plaintiff had failed to explore the internal mechanisms of the party to resolve the issue before approaching the court.
The judge emphasized that the appointment of officers within APC is an internal affair of the party, beyond the jurisdiction of any court.
As a result, the suit was dismissed. In his final ruling, Justice Ekwo stated, “The claimant has no locus standi, and I strike out the suit for lack of legal standing. This matter is an internal affair of the political party.”
